S.D. Ind. denied Cook Medical’s motion for attorney’s fees and costs in dispute with Endotach

March 6, 2014 – The District Court for the Southern District of Indiana denied Cook Medical Incorporated’s motion for attorney’s fees and costs related to Endotach LLC’s lack of standing. The court had previously dismissed plaintiff Endotach’s complaint of patent infringement, filed on June 21, 2012, without prejudice because at the time of filing Endotach had no ownership interest in the patents at issue—U.S. Patent Nos. 5,122,154, which is directed to an endovascular bypass graft, and 5,593,417, which is directed to an intravascular stent with secure mounting means. The case is assigned to District Judge Larry J. McKinney and Magistrate Judge Denise K. LaRue.
