Pender granted-in-part and denied-in-part respondents BMC Medical Co., 3B Medical, Inc., and 3B Products, LLC’s motion to strike petitioner ResMed Corp.’s reliance on certain belatedly identified priority evidence. The patents-in-suit are U.S. Patent Nos 7,178,527, 7,341,060, 7,614,398, 7,926,487, 7,938,116, 7,950,392, 7,997,267, 8,312,883, and RE44453 directed to sleep-disordered breathing treatment systems and components thereof, used in the treatment of obstructive sleep apnea by delivering continuous positive airway pressure (CPAP).
