Judge denies DePuy Synthes Products, LLC’s motions for attorneys’ fees and permanent injunction in infringement action against Globus Medical Inc.

March 25, 2014- In DePuy Synthes Products, LLC v. Globus Medical Inc., (1-11-cv-00652) (D. Del.), District Judge Leonard P. Stark, following a jury trial finding and summary judgment that plaintiff’s patents were valid and infringed, denied plaintiff’s motions for attorneys’ fees under 35 U.S.C. § 285 and permanent injunction and destruction of infringing products, granted plaintiff’s motion for pre-judgment interest, and granted-in-part plaintiff’s motion for an ongoing royalty. The court also denied defendant’s renewed motion for judgment as a matter of law. The patents-in-suit are U.S. Patents 7,846,207, 7,862,616, and 7,875,076 covering inter-vertebral implants and methods of using them in spinal fusion procedures.
