US ITC denies BMC Medical’s motion for summary determination of invalidity

March 27, 2014-The U.S. International Trade Commission denied BMC Medical Co. Ltd’s motion for summary determination of invalidity of U.S. Patent No. RE44,453, relating to certain sleep-disorder breathing treatment systems and components thereof. Administrative Law Judge Thomas B. Pender ruled that there was a genuine dispute of material fact regarding at least one limitation, and therefore denied BMC’s motion.
