University of Michigan Bioprosthetic Tissue patent claims held unpatentable in IPR

May 1, 2014 – The PTAB ordered that all challenged claims are unpatentable under 35 U.S.C. 103 in St. Jude Medical, Cardiology Division, Inc. v. The Board of Regents of the University of Michigan (IPR2013-00041). The PTAB “considered the scope and content of the prior art; the differences between the prior art and the challenged claims; the level of ordinary skill in the art; and the objective indicia of nonobviousness.” U.S. Patent No. 5,746,775 is directed to methods of treating collagenous biomaterial to prevent in vivo calcification prior to implantation.
