Order directing entry of consent partial judgment of non-infringement issued in Bonutti Skeletal v. Anthrex

May 16, 2014 – Chief District Judge Anne C. Conway of the United States District Court of the Middle District of Florida issued an order directing entry of consent partial judgment of non-infringement, both literal and under the doctrine of equivalents, regarding Bonutti Skeletal Innovations LLC’s third count of infringement. The parties—Plaintiff Bonutti Skeletal and Defendant Anthrex, Inc.—filed a joint motion for entry of consent partial judgment on May 13, 2014. Among other counts, Bonutti Skeletal had filed suit against Anthrex for infringement of U.S. Patent No. 5,921,986 (Count III), directed to a method and apparatus for securing sections of fractured bone and securing body tissue to bone.
