Order on Summary Judgment Motions in Excelsior Medical Corporation v. Ivera Medical Corporation

November 5, 2014 – The District Court for the Southern District of Florida denied Plaintiffs Excelsior Medical Corporation, Covidien LP, and Covidien Sales, LLCs’ Motion for Summary Judgment of (1) Invalidity for Anticipation and (2) Invalidity for lack of Written Description. The court also granted Defendants Ivera Medical Corporation, Robert F. Lake, Jr., and Jeffrey S. Tennants’ Motion for Summary Judgment of Validity of Claim 1, but denied Defendants’ Motion for Summary Judgment of Infringement of Claim 1. The patent at issue is U.S. Patent No. 7,282,186 covering a decontamination device for decontaminating medical apparatuses, such as stethoscopes. The case is pending in the Southern District of Florida and is captioned Excelsior Medical Corporation v. Ivera Medical Corporation, 13-8084-cv-Middlebrooks.
