Petition for Inter Partes Review by Terumo Cardiovascular Systems Corp. (IPR2015-00263)

On November 13, 2014, Petitioner, Terumo Cardiovascular Systems Corporation (“Terumo”), filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of all of the claims of U.S. Patent No. 6,423,268 (“the ‘268 Patent”) drawn to a blood heating system with mutually exclusive relay-controlled heat exchangers. The ‘268 Patent, which issued on July 23, 2002, is owned by Luther M. King of Grapeland, Texas. In the Petition, Terumo asserts the following grounds: (i) all claims are obvious under 35 U.S.C. § 103 over a 1996 3M Guide to certain cardiovascular system products in view of U.S. Patent No. 4,010,412 (“the ‘412 Patent”), (ii) claims 1-3, 5-14, and 16-18 are obvious under 35 U.S.C. § 103 over a 1994 3M Manual to certain cardiovascular system products in view of U.S. Patent Nos. 3,767,894 and 6,246,831, and (iii) all claims are obvious under 35 U.S.C. § 103 over U.S. Patent No. 5,702,358 in view of the ‘412 Patent. The inter partes review remains pending at the Board and is captioned IPR2015-00263.
