Motion to reconsider IPR institution denied

November 17, 2014 – The Patent Trial and Appeals Board denied petitioner’s request for rehearing of an earlier decision denying institution of inter partes review with respect to some of the claims in the petition, finding that the Board did not abuse its discretion in narrowing the alleged claim scope based on the patent specification, using the broadest reasonable construction. Wright Medical had successfully petitioned for IPR of some claims of the Univ. of North Carolina’s and AngleFix Tech, LLC’s patent, 6,955,677, titled “Multi-angular fastening apparatus and method for surgical bone screw/plate systems.” Petition for Inter Partes Review by Wright Medical Technology, Inc., IPR2014-00626 (PTAB).
