Claim construction order in Applied Medical Resources Corporation v. Tyco Healthcare Group LP

November 21, 2014 – Judge James V. Selna issued a claim construction order in the suit filed by Plaintiff Applied Medical Resources Corporation against Defendant Tyco Healthcare Group LP for patent infringement. The court reviewed twelve disputed claim terms in US Patent No. 8,496,581 B2 (the ‘581), which relates to devices that seal a body cavity while permitting surgical instruments to cross a body wall. For ten of the claim terms, the court determined the terms were sufficiently clear and did not require construction. The court construed the remaining two terms: (1) “elastomeric material” was construed to mean “a material that returns approximately to its original size and shape after substantial deformation” and (2) “foaming agent” was construed to mean “a substance used to produce foaming”. The case is pending in the Central District of California, Southern Division and is captioned Applied Medical Resources Corporation v. Tyco Healthcare Group LP, 11-cv-01406-JVS(ANx).
