Court grants motion for enhanced damages, attorneys’ fees, and permanent injunction

December 18, 2014 – United States District Judge Marilyn L. Huff, in the Southern District of California, found Plaintiff RawCar Group, LLC d/b/a/ CFI Medical Solutions proved objective willfulness of infringement and granted Plaintiff’s motions for enhanced damages, attorneys’ fees, and a permanent injunction against Defendants Grace Medical, Inc., Pulse Medical, Inc., J. Randall Pittman d/b/a/ Preferred Medical Products, and Preferred Medical Products, LLC. Additionally, Judge Huff issued a judgment upholding a jury’s verdict of $315,000 of damages. The patents at issue are U.S. Patent No. 8,042,549, entitled Sterile radiological drape, and U.S. Patent No. 8,286,637, entitled, Sterile radiological imaging unit drape and method of proving a sterile surface therewith. This case is captioned RawCarGroup, LLC v. Grace Medical, Inc., et al., 3:13-cv-01105 H (BLM).
