Petition for Inter Partes Review by Troy Norred (IPR2015-00477)

On December 22, 2014, Petitioner, Troy Norred, MD (“Norred”), filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of claims 1-18 of U.S. Patent No. 7,914,569 (“the ‘569 Patent”) drawn to a heart valve prosthesis and methods of manufacture and use. The ‘569 Patent, which issued on March 29, 2011, is owned by Medtronic CoreValve, LLC. In the Petition, Norred asserts the following grounds: (i) claims 1-18 are anticipated by U.S. Patent No. 7,044,966 (“the ‘966 Patent”), (ii) claims 1-18 are anticipated by U.S. Patent No. 7,201,772 (“the ‘772 Patent”), (iii) claims 1-18 are anticipated by U.S. Patent No. 6,730,118 (“the ‘118 Patent”), (iv) claims 1-18 are obvious over the ‘966 Patent in view of U.S. Patent No. 7,320,704 (“the ‘704 Patent”), (v) claims 1-18 are obvious over the ‘772 Patent in view of the ‘966 Patent, (vi) claims 1-18 are obvious over the ‘118 Patent in view of the ‘772 Patent, (vii) claims 1-18 are obvious over the ‘772 Patent in view of the ‘966 Patent and the ‘704 Patent, and (viii) claims 1-18 are obvious over the ‘118 Patent in view of the ‘772 Patent and the ‘704 Patent. The inter partes review remains pending at the Board and is captioned IPR2015-00477.
