ITC finds imported breathing apparatus in violation of Tariff Act

December 29, 2014 – The United States International Trade Commission found that BMC Medical Co., 3B Medical Inc. and 3B Products LLC were in violation of section 337 of the Tariff Act of 1930 for the unlawful importation or sale of certain sleep-disordered breathing treatment systems and components thereof. The patents-at-issue were U.S. Patent Nos. 7,178,527, 7,950,392, 7,997,267, 7,341,060 and 8,312,883, which are owned by ResMed Ltd. The case is captioned In the Matter of Certain Sleep-Disordered Breathing Treatment Systems and Components Thereof, Investigation No. 337-TA-890, in the United States International Trade Commission.
