Federal Circuit refuses en banc hearing on EMD Millipore’s infringement claims

January 12, 2015 – The Federal Circuit decided not to rehear en banc the panel’s decision of noninfringement in the litigationEMD Millipore Corp. v. AllPure Technologies Inc., 2014-1140 (Fed. Cir.).  The litigation related to infringement by AllPure of EMD Millipore’s U.S. Patent No. 6,032,543, entitled “Device for Introduction and/or Withdrawal of a Medium Into/From a Container.”  The Federal Circuit in September affirmed the lower court’s decision of summary judgment of non-infringement, ruling that EMD Millipore’s device did not contain a “transfer member” and that prosecution history estoppel prevented EMD Millipore from asserting a doctrine of equivalents claim.
