Petition for inter partes review by IntroMedic, Co. Ltd. (IPR2015-00579)

On January 16, 2015, Petitioner, IntroMedic Co., Ltd. (“IntroMedic”), filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of claim 1 of U.S. Patent No. 7,009,634 (“the ‘634 Patent”) drawn to a device for in-vivo imaging. The ‘634 Patent, which issued on March 7, 2006, is owned by Given Imaging Ltd. In the Petition, IntroMedic asserts the following grounds: (i) claim 1 is obvious under 35 U.S.C. § 103 over U.S. Patent No. 6,277,064 (“Yoon”) in view of JP 10-216085 (“Katsunori”) and JP 57-45833 (“the Gastric Camera Patent”), (ii) claim 1 is obvious under 35 U.S.C. § 103 over EP 0941691 (“Welch Allyn”) in view of the Gastric Camera Patent, (iii) claim 1 is obvious under 35 U.S.C. § 103 over WO 1999/030610 (“Iddan”) in view of Welch Allyn or in view of Katsunori and U.S. Patent No. 5,734,418 (“Danna”), (iv) claim 1 is obvious under 35 U.S.C. § 103 over U.S. Patent No. 6,324,418 (“Boston Scientific”) in view of Katsunori and Danna, and (v) claim 1 is obvious under 35 U.S.C. § 103 over JP 1992-14453 (“Olympus”) in view of Katsunori and Danna. The inter partes review remains pending at the Board and is captioned IPR2015-00579.
