January 23, 2015 – Patent Trial and Appeal Board Administrative Patent Judge John G. New issued a decision on January 21, granting a request by Ivera Medical Corp. for inter partes review of Catheter Connections, Inc.’s U.S. Patent No. 8,647,326, entitled “System For Cleaning Luer Connectors” in Case IPR2014-01124. APJ New, along with panel members Josiah C. Cocks and Meredith C. Petravick, granted the IPR over claims 1-9, 12, and 14-16 on the grounds of Section 103 obviousness, while denying the IPR over claims 1, 4-9, 12, and 14-16 on the grounds of Section 102 anticipation. Catheter Connection’s ’326 patent is also the subject of the lawsuit Excelsior Medical Corp. v. Ivera Medical Corp., Case No. 1-14-cv-00852 (D.N.J. Feb. 11, 2014). Both companies market medical devices that are disinfectant caps incorporated into intravenous lines that deliver fluids and drugs to patients. Catheter Connections is currently marketing its product as DualCap; Ivera markets its product as Curos Tips.
