Court denies Zoll Medical’s motion for summary judgment of non-infringement

February 3, 2015 – The District of Massachusetts denied defendant Zoll Medical’s motion for summary judgment of non-infringement of U.S. Patent Nos. 7,463,922 and 5,441,520 related generally to defibrillator technology. However, the Court granted, in part, summary judgment concerning a limitation on damages for Philip’s failure to properly mark its products under 35 U.S.C. §287(a). The case is captioned Koninklijke Philips N.V. et al. v. Zoll Medical Corp., 12-cv-12255-NMG.
