PTAB denies institution of IPR on system for aligning vertebrae

February 20, 2015 – The PTAB denied Medtronic, Inc. its petition for inter partes review of U.S. patent No. 8,361,121 claiming a spinal column derotational system.  The PTAB held that “we are not persuaded that Petitioner has demonstrated a reasonable likelihood of prevailing in demonstrating that claims 1–4 are unpatentable as obvious over the [prior art references].”  The case is captioned Medtronic, Inc. v. Barry, IPR2014-01211.
