Complaint filed by Flexuspine, Inc. against Globus Medical, Inc.

On March 11, 2015, Flexuspine, Inc. (“Plaintiff”) filed a complaint against Globus Medical, Inc. (“Defendant”) asserting infringement of U.S. Patent Nos. 7,204,853 (“the ‘853 Patent”), 7,316,714 (“the ‘714 Patent”), 7,909,869 (“the ‘869 Patent”), 8,123,810 (“the ‘810 Patent”) and 8,647,386 (“the ‘386 Patent”).  The ‘853 Patent, the ‘714 Patent, the ‘869 Patent, the ‘810 Patent, and the ‘386 Patent are all assigned to the Plaintiff and generally relate to a device that can be implanted between two vertebral bodies of a human spine.  The Plaintiff is asserting that the Defendant is infringing the ‘853 Patent, the ‘714 Patent, the ‘869 Patent, the ‘810 Patent, and the ‘386 Patent by making, using, offering for sale, and/or selling expandable intervertebral fusion devices, including the Globus’ Caliber and Caliber-L products.  The case remains pending and is captioned 6:15-cv-000201.
