Federal Circuit denies W.L. Gore’s request for panel rehearing and rehearing en banc in dispute against Bard

April 9, 2015 – In a per curiam order issued on April 8, 2015, the Federal Circuit denied W.L. Gore & Associates, Inc.’s request for panel rehearing and a rehearing en banc related to its willful infringement damages claims in excess of $1 billion they have been ordered to pay to Plaintiffs Bard Peripheral Vascular, Inc. and C.R. Bard, Inc.  The lawsuit relates to W.L. Gore’s infringement of C.R. Bard’s blood vessel graft patent, U.S. Patent No. 6,436,135, entitled “Prosthetic Vascular Graft.”
