On May 11, 2015, Petitioners, 3D Diagnostix, Inc., Dental Wings Inc., Implant Solutions LLC, and Institut Straumann AG (“Petitioners”) filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of claims 1-10 of U.S. Patent No. 6,319,006 (“the ‘006 Patent”) drawn to a method for producing a drill assistance tool for a tooth implant. The ‘006 Patent, which issued on November 20, 2001, is owned by Sirona Dental Systems GmbH. In the Petition, Petitioners assert that claims 1-10 of the ‘006 Patent are invalid under 35 U.S.C. §§ 102(b) and/or 103(a) over a 1995 Journal of Image Guided Surgery Article, U.S. Patent No. 5,562,448, U.S. Patent No. 5,842,858, and/or German Patent No. 195 10 294. The inter partes review remains pending at the Board and is captioned IPR2015-01190.
