Petitions for Inter Partes Review by Globus Medical, Inc.

On June 4, 2015, Petitioner, Globus Medical, Inc. (“Globus”), filed three Petitions to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of (i) claims 1, 12, 14, 44, 47, and 53 of U.S. Patent No. 8,795,363 (“the ‘363 Patent”), (ii) claims 1, 2, 3, 8, 9, 10, 13, 16, 17, and 18 of U.S. Patent No. 8,486,066 (“the ‘066 Patent”), and (iii) claims 1, 10, 11, 14, 23, 24, and 26 of U.S. Patent No. 7,001,385 (“the ‘385 Patent”).  The ‘363 Patent, the ‘066 Patent, and the ‘385 Patent, which are all owned by Bonutti Skeletal Innovations, Inc., are drawn to a wedge apparatus for use in operating on a bone, spacers, and joint spacers, respectively.  In each of the Petitions, Globus asserts various invalidity contentions under 35 U.S.C. §§ 102 and/or 103 over several prior art documents that include U.S. Patents and foreign patent documents.  The inter partes reviews remain pending at the Board and are captioned IPR2015-01333, IPR2015-01335, and IPR2015-01339, respectively.
