PTAB declines to institute IPR on Medtronic patent

June 9, 2015 – Patent Trial and Appeal Board Administrative Patent Judge William V. Saindon issued a decision on June 4, denying a request by Troy R. Norred for inter partes review of Medtronic CV Luxembourg S.a.r.l.’s U.S. Patent No. 7,914,569, entitled “Heart Valve Prosthesis and Methods of Manufacture and Use” in Case IPR2015-00477.  APJ Saindon, along with panel members Josiah C. Cocks and James A. Worth, declined to institute the IPR because Norred’s petition failed to establish that the ’569 patent was either anticipated or obvious over any of the asserted prior art.  Medtronic’s ’569 patent is directed to a heart valve prosthesis that provides improved durability.
