Bonutti Skeletal’s Suit against Globus Medical is dismissed for failure to state a claim

June 18, 2015 – The district court for the Eastern District of Pennsylvania granted Defendant Globus Medical Inc.’s motion to dismiss claims of direct, induced, contributory, and willful infringement brought by Plaintiff Bonutti Skeletal Innovations, LLC. The 6 patents at issue relate to orthopedic implants: U.S. Patent Nos. 6,099,531; 6,423,063; 7,001,385; 8,486,066; 8,690,944; 8795,363. In granting the motion to dismiss, the court determined Bonutti failed to state sufficient facts demonstrating Globus Medical had control over the doctors alleged to perform the infringing procedures, knowledge of the alleged infringement, or specific intent to induce infringement. The case is captioned Bonutti Skeletal Innovations LLC v. Globus Medical, Inc., 14-cv-06650.
