PTAB declines to reconsider institution of IPR on Oticon A/S’s patent

June 22, 2015 – Patent Trial and Appeal Board Administrative Patent Judge Frances L. Ippolito issued a decision on June 18, denying a request for rehearing by GN ReSound A/S for inter partes review of Oticon A/S’s U.S. Patent No. 8,300,863, entitled “Hearing Device and Method for a Wireless Receiving and/or Sending of Data” in Case IPR2015-00103.  GN ReSound filed the motion for reconsideration after the Patent Board denied institution of inter partes review in a previous April 29, 2015 decision.  APJ Ippolito, along with APJ Neil T. Powell, declined to reconsider institution of the IPR because GN ReSound’s petition was deficient, noting that it failed to “align the evidence and arguments with the various limitations of the challenged claims.”
