Petition for Inter Partes Review by US Endodontics, LLC (IPR2015-01476)

On June 25, 2015, Petitioner, US Endodontics, LLC (“Petitioner”), filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of claims 1, 4, 5, 8-10, and 12 of U.S. Patent No. 8,727,773 (“the ‘773 Patent”) drawn to dental and medical instruments comprising titanium.  The ‘773 Patent, which issued on May 20, 2014, is owned by Gold Standard Instruments, LLC.  In the Petition, Petitioner asserts the following grounds: (i) claims 1, 4, 5, 9-10, and 12 are obvious under 35 U.S.C. § 103(a) over a 1994 Dental Materials Journal Article (“Endo”) in view of a 2003 Endodontics Journal Article (“Tripi”) and further in view of US Patent Application Publication No. 2002/0137008 (“McSpadden”), and (ii) claim 8 is obvious under 35 U.S.C. § 103(a) over Endo in view of Tripi, McSpadden, and International Standard ISO 3630-1 (1992).  The inter partes review remains pending at the Board and is captioned IPR2015-01476.
