June 30, 2015 – The PTAB found claims to U.S. Patent No. 6,482,228 related to an aortic heart valve unpatentable as anticipated under 35 U.S.C. § 102(b) and 102(e). The Board reasoned that the patent owner did not bear its burden in establishing it conceived of the claimed invention prior to the conception of U.S. Patent No. 5,957,949 titled, “Percutaneous Placement Valve Stent” and U.S. Patent No. 6,458,153 titled, “Endoluminal Cardiac and Venous Valve Prostheses and Methods of Manufacture and Delivery Thereof.” The case is captioned Medtronic, Inc. et al. v. Troy R. Norred, M.D., IPR2014-00395.
