Petitions for Inter Partes Review by CR Bard, Inc.

On July 31, 2015, Petitioner, CR Bard, Inc. (“Petitioner”), filed two Petitions to the USPTO’s Patent Trial and Appeal Board (“Board”) for inter partes review of (i) claims 1-22 of U.S. Patent No. 8,852,160 (“the ‘160 Patent”) and (ii) claims 1, 2, 5-13, 15-19, 21, and 22 of U.S. Patent No. 8,257,325 (“the ‘325 Patent).  The ‘160 Patent and the ‘325 Patent are drawn to a venous access port with molded and/or radiopaque indicia.  The ‘160 Patent, which issued on October 7, 2014, and the ‘325 Patent, which issued on September 4, 2012, are both owned by Innovative Medical Devices, LLC and Medical Components, Inc.  In the Petitions, Petitioner asserts that the various claims of the asserted patents are obvious under 35 U.S.C. § 103(a) over various non-patent literature and patent documents.  The inter partes reviews remain pending at the Board and are captioned IPR2015-01654 and IPR2015-01660, respectively.
