On August 21, 2015, a federal jury in the U.S. District Court for the Eastern District of Texas concluded that Rex Medical, L.P. and Argon Medical Inc. (“Defendants”) did not infringe U.S. Patent No. 8,052,670 (“the ‘670 Patent”), owned by EVM Systems, LLC (“Plaintiff”). In the underlying case, the Plaintiff accused the Defendants of infringing the ‘670 Patent, which is drawn to a medical device with a slotted memory tube, by making and distributing their vena cava filters. In the decision, the federal jury upheld the validity of the ‘670 Patent, but also returned a verdict of noninfringement in favor of the Defendants. The case remains pending and is captioned 6:13-cv-00184.
