Court Grants Stay to Boston Scientific in Dispute Over Cardiac Defibrillator Technology

August 25, 2015 – United States District Court Judge Staci G. Cornelius issued an “Order” on August 21 granting Boston Scientific Corporation’s motion to stay the proceedings pending the PTAB’s disposition of Boston Scientific’s inter partes review petition over the patent at issue in its lawsuit against the Board of Trustees of the University of Alabama.  The patent at issue is U.S. Patent No. 6,266,563, entitled “Method and Apparatus for Treating Cardiac Arrhythmia.”  The case is Board of Trustees of the University of Alabama et al. v. Boston Scientific Corporation et al., Case No. 2:15-cv-01800-SGC (N.D. Ala., Southern Division).  The ’563 patent is directed to methods and an implantable apparatus for treating cardiac arrhythmia, particularly ventricular fibrillation.
