Jury Finds EVM’s Patent Not Infringed and Not Invalid

August 26, 2015 – A jury in the Eastern District of Texas found that EVM Systems did not prove by a preponderance of the evidence that Rex Medical and Argon Medical Devices infringed claim 1 of U.S. Patent No. 8,052,670, titled “Medical Device with Slotted Memory Metal Tube.”  The jury also found that Rex Medical and Argon Medical did not prove by clear and convincing evidence that claims 1, 2 and 11 of the ’670 patent are invalid for lack of enablement.

The case is captioned EVM Systems, LLC v. Rex Medical, L.P., et al., 13-CV-184, in the Eastern District of Texas, Tyler Division.
