September 25, 2015 – ArthroCare Corp. filed an amended answer and counterclaim for patent infringement against Arthrex, Inc. on September 23, 2015 in the United States District Court for the Eastern District of Texas (Marshall Division). ArthroCare added a new patent to the ongoing litigation, filed initially by Anthrex against ArthroCare and Smith & Nephew, Inc. The lawsuit relates to ArthroCare and Smith & Nephew’s allegedly infringing suture anchors, used for soft tissue reattachment and reconstruction procedures in the hip joint. ArthoCare’s newly added patent at issue is U.S. Patent No. 7,090,690, entitled: “Devices and Methods for Repairing Soft Tissue,” which relates to devices and methods for repairing soft tissue and for arthroscopic repair of a torn rotator cuff. The lawsuit is Arthrex, Inc. v. Smith & Nephew, Inc. et al., Civil Action No. 2:15-cv-1047-JRG (E.D. Tex.).
