Varian Medical Systems Files ITC Complaint against Elekta

September 29, 2015 – On September 25, 2015, Varian Medical Systems, Inc. and Varian Medical Systems International AG (collectively “Varian”) filed a complaint entitled Certain Radiotherapy Systems and Treatment planning Software, and Components Thereof, naming respondents Elekta AB of Sweden; Elekta Ltd. of The United Kingdom; Elekta Gmbh of Germany; Elekta Inc. of Atlanta, GA; IMPACT Medical Systems, Inc. of Sunnyvale, CA; Elekta Instrument (Shanghai) Limited of China and Elekta Beijing Medical Systems Co. Ltd. of China (collectively, “Elekta”).  The complaint requests that the International Trade Commission issue a permanent limited exclusion order, cease and desist orders, and a bond upon Elekta’s alleged infringing articles.  Varian accuses Elekta of infringing U.S. Patent Nos. 7,880,154 (“Methods and apparatus for the planning and delivery of radiation treatments”), 7,906,770 (“Methods and apparatus for the planning and delivery of radiation treatments”), 7,945,021 (“Multi-mode cone beam CT radiotherapy simulator and treatment machine with a flat panel imager”), 8,116,430 (“Multi-mode cone beam CT radiotherapy simulator and treatment machine with a flat panel imager”),8,696,538 (“Methods and apparatus for the planning and delivery of radiation treatments”) and 8,867,703 (“Multi-mode cone beam CT radiotherapy simulator and treatment machine with a flat panel imager”).

The complaint has been given Investigation No. 337-TA-3086.
