October 13, 2015 – Plaintiffs, Drägerwerk AG & Co. KCaA, Draeger Medical Systems, Inc., and Draeger Medical Inc. (collectively, “Draeger”) filed a complaint, demanding a jury trial and injunctive relief, against Allied Healthcare Products, Inc. (“Allied”), and asserted infringement of U.S. Reissue Patent No. RE45745 in the United States District Court of Delaware. The ’745 Reissue Patent is a reissue of U.S. Patent No. 8,286,633 (“the ’633 Patent”). Draeger asserts that it is the owner by assignment of all rights and interests related to the asserted patent. The ‘745 Reissued Patent is titled, “Carbon dioxide absorber for a rebreathing system” and is directed to cartridges that house carbon dioxide absorbents used in Draeger’s CLIC adapters for anesthesia machines. According to the Complaint, the action arises from Allied’s manufacturing, using, importing, offering for sale, and/or selling of carbon dioxide absorbent “Draeger style” cartridges, which operate in connection with Draeger’s CLIC adapters. The case remains pending Drägerwerk AG & Co. KCaA et al. v. Allied Healthcare Products Inc., _ – __ -cv- ____ (DED).
