Complaint filed by Boston Scientific Corp. against Cook Group Inc. for Patent Infringement

October 28, 2015 – Plaintiffs, Boston Scientific Corporation and Boston Scientific Scimed Inc., filed a Complaint in the United States District Court for the District of Delaware against Defendants Cook Group Inc. and Cook Medical LLC alleging patent infringement. The patents at issue are U.S. Patent No. 8,685,048, entitled “Device and method for through the scope endoscopic hemostatic clipping,” U.S. Patent No. 8,709,027, entitled “Device and method for through the scope endoscopic hemostatic clipping,” and U.S. Patent No. 8,974,371, entitled “Through the scope tension member release clip.”

Plaintiffs develop, manufacture, and supply medical devices. One such device is the ResolutionTM Clip, an endoscopic hemostasis clip that is intended to stop bleeding in the gastrointestinal tract. Plaintiffs’ product is covered by the ’048, ’027, and ’371 Patents. Plaintiffs claim that the Defendants’ product, the InstinctTM Endoscopic Hemoclip, infringes the ’048, ’027, and ’371 Patents in violation of 35 U.S.C. § 271. The case has been filed in the District of Delaware and is captioned: Boston Scientific Corporation et al v. Cook Group Incorporated et al, DED-1-15-cv-00980.
