November 30, 2015 – Plaintiff Disc Disease Solutions, Inc. (“DDS”) filed a complaint against Defendants VGH Solutions Inc., Dr-Ho’s Inc., and Hoi Ming Michael Ho (collectively, “Defendants”), asserting infringement of U.S. Patent Nos. 7,618,509 (entitled “Wrinkled band without air expansion tube and its manufacturing method”) and 8,012,113 (entitled “Spinal brace”) in the United States District Court for the Middle District of Georgia. DDS claims it is owner of all rights and title of interest in Patent ‘113, and is the exclusive licensee of Patent ‘509 with the exclusive right to bring infringement actions. According to the complaint, the action arises from Defendants’ distributing, selling, offering for sale, marketing, advertising, importing, making and/or using products, including inflatable belts (marketed as the DBB 3500 and DBB 3000), that fall within the scope of one or more of the ‘113 and ‘509 Patents’ claims. The case remains pending and is captioned Disc Disease Solutions Inc. v. VGH Solutions, et al, 1-15-cv-00188 (GAMD).
