Institution Denied for Inter Partes Review by Boston Scientific Neuromodulation Corporation

November 30, 2015 – Petitioner Boston Scientific Neuromodulation Corporation (“BSNC”) filed a Petition requesting inter partes review at the Patent Trial and Appeal Board (“PTAB”)  of claims 1, 2, 11-15, 17-23, and 26 of U.S. Patent No. 8,359, 102 B2. The ‘102 Patent, owned by Nevro Corporation, is directed towards applying selective high frequency modulation to the spinal cord to control pain. The PTAB denied the institution of an IPR because Petitioner did not sufficiently establish a reasonable likelihood that it would prevail on the claims at issue. The case was decided by the Patent Trial and Appeal Board and is captioned Petition for Inter Partes Review by Boston Scientific Neuromodulation Corporation, IPR2015-01203 (PTAB).
