December 3, 2015—Judge Leonard P. Stark issued a memorandum opinion addressing claim construction and summary judgement in a case filed by Plaintiff Masimo Corporation accusing Defendant Phillips Electronics of patent infringement. In the opinion, the court construed 9 claim terms from 4 patents at issue which relate to devices taking blood oximetry measurements: U.S. Patent Nos. 6,157,850; 7,509,154; 8,019,400; and 5,337,745. The court denied Defendant’s motion for summary judgement because a person having ordinary skill in the art would understand the claim “given the identical claim structure” and “the context” (page 11). The case is pending in the District of Delaware and captioned Masimo Corporation v. Philips Electronics North America Corporation et al., 1:09-cv-00080.
