W.L. Gore & Associates Inc.’s Stent Graft Patents Upheld, C.R. Bard’s Motion to Strike Granted

December 4, 2015 – On December 2, 2015, Plaintiff W.L. Gore & Associate’s stent graft patents were found not invalid, Defendant C.R. Bard Inc. (“Bard”) was found not to have willfully infringed the patents, and Bard was barred from alleging indefiniteness at trial based on a ruling of definiteness made at summary judgment. The court also granted Bard’s Motion to Strike the Supplemental Expert Report of Dr. Enrique Criado on Comparable Technologies.

The patents-at-issue are both titled “Intraluminal Stent Graft,” and are U.S. Patent Nos. 5,735,892 and 5,700,285.  The case is captioned 1:11-cv-00515 and is pending in the United States District Court for the District of Delaware.
