Patent Trial and Appeal Board Grants Motion to File Sanctions in IPR Proceeding

December 15, 2015— Administrative Patent Judge Sheridan K. Snedden granted motion made by Patent Owner LifeNet Health of U.S. Patent No. 9, 125, 971, entitled “Plasticized bone and soft tissue grafts and methods of making and using same,” for leave to file motion for sanctions. During a teleconference with the PTAB, Patent Owner requested authorization to move for sanctions against Petitioner LifeCell Corporation for violation of a protective order in a related district court case, currently on appeal with the United States Court of Appeals for the Federal Circuit. In interest of having a complete record to resolve the issue, Administrative Patent Judge Snedden granted authorization to file a motion of sanctions, but noted the grant does not reflect a decision on the merits of the allegations. This action is pending in the USPTO and is captioned Petition for Inter Partes Review by LifeCell Corporation, IPR2015-01888 (PTAB).
