December 30, 2015– On December 29, DePuy Synthes petitioned for inter partes review of two patents directed to bone spacing devices for use in orthopedic surgery. On the same day, patent owner Bonutti Skeletal Innovations filed preliminary responses to the petitions. The patents have also been challenged by Globus Medical before the PTAB in a pair of petitions for inter partes review which were granted on December 18. The patent owner asserted the patents against Globus Medical and DePuy Synthes in separate suits filed in December, 2014.
The patents at issue are U.S. Patent No. 8,486,066, titled “Spacer,” and U.S. Patent No. 8,795,363, titled “Wedge Apparatus For Use In Operating On A Bone.” The inter partes review proceedings brought by DePuy Synthes are captioned IPR2016-00411 and IPR2016-00412.
