Court Grants in Part and Denies in Part LD Technology’s Renewed Motion for Extension of Trial

January 25, 2016—A Renewed Unopposed Motion for Extension of Trial (“Renewed Motion”) filed by Counterclaim Defendants LD Technology, LLC and Albert Maarek was granted in part and denied in part. The Renewed Motion was filed one day after the court denied an initial motion requesting that the court “extend all trial and pretrial deadlines to allow the parties to focus their resources on settlement.” Based on the Renewed Motion, the deadline for exchanging expert witness summaries or reports, and the deadline for exchanging rebuttal expert witness summaries or reports were each extended by one week; no other deadlines were extended. The patent-at-issue is U.S. Patent No. 8,655,443 entitled “Electrophysiological Analysis System.” The Plaintiff is LD Technology LLC, the Defendant is Impeto Medical SAS, the Counterclaimant is Impeto Medical, Inc., and the Counter Defendant is Albert Maarek. The case, captioned No. 15-20109, is pending in the United States District Court for the Southern District of Florida.
