Smith & Nephew and ArthroCare File Five IPR Petitions Against Arthrex

January 25, 2016—Smith & Nephew, Inc. and ArthroCare Corporation (“Petitioners”) filed five petitions for the institution of inter partes review (“IPR”), seeking cancellation of the following claims: in IPR2016-00483, claims 1-4 and 8-16 of U.S. Patent No. 6,511,499 (“’499 patent”); in IPR2016-00486, claims 5-7 of the ’499 patent; in IPR2016-00484, claims 1, 11, 12, 14, 16, 18-22 of US. Patent No. 6,214,031; in IPR2016-00485, claims 1-4 of U.S. Patent No. 7,195,634 (“’634 patent”); and in IPR 2016-00487, claims 5-13 of the ’634 patent. Arthrex, Inc. owns the three patents-at-issue, which are directed to screw-based “suture anchors” for affixing suture to bone. Arthrex is asserting these three patents against Petitioners in the Eastern District of Texas, Case No. 2:15-cv-01047. The IPRs are pending before the Patent Trial and Appeal Board.
