Court Denied, in Part, and Granted, in Part, Plaintiffs Trainingmask LLC’s Motion for Default Judgment

February 16, 2016 – The Court denied, in part, and granted, in part, Plaintiffs’ Trainingmask LLC and Casey J. Danford’s motion for Default Judgment. The patents at issue are U.S. Patent No. 8,590,533, entitled “Adjustable inhalation resistance exercise device,” and U.S. Patent No. 9,067,086, entitled “High performance ventilatory training mask incorporating multiple and adjustable air admittance valves for replicating various encountered altitude resistances.”

The Court found Defendants to have willfully infringed both the ’533 and ’086 Patents. Furthermore, the Court permanently enjoined the Defendants from making, using, selling, offering to sell in the United States, or importing into the United States products that infringe the ’533 and ’086 patents. The case is in the District of New Jersey and is captioned: TRAININGMASK LLC et al v. MY CORP. LLC et al, NJD-1-15-cv-06789.
