Court Denies Defendant Carl Zeiss Microscopy’s Motion to Stay

February 16, 2016 – The Court denied, without prejudice, Defendant Carl Zeiss Microscopy’s motion to stay pending its petition for inter partes review. The patent at issue is U.S. Patent No. 6,313,452, entitled “Microscopy system utilizing a plurality of images for enhanced image processing capabilities.”

The Court reasoned that the “start and stop” process created by staying a case pending an IPR undermines the court’s interest in efficiently managing its docket. The case is pending in the District of Delaware and is captioned: Advanced Microscopy Inc. v. Carl Zeiss Microscopy, LLC, DED-1-15-cv-00516.
