PTAB Institutes IPR on Two Flexuspine, Inc. Patents, but Denies Institution on Another

February 26, 2016 – The United States Patent and Trademark Office Patent Trial and Appeal Board instituted two petitions for Inter Partes Review by Globus Medical, Inc. concerning claim 5 of Flexuspine, Inc.’s U.S. Patent No. 7,204,853 and claims 23 and 37 of Flexuspine, Inc.’s U.S. Patent No. 7,909,869. Both of these patents are entitled “Artificial Functional Spinal Unit Assemblies.” The cases are captioned, Globus Medical, Inc. v. Flexuspine, Inc., IPR2015-01749 and Globus Medical, Inc. v. Flexuspine, Inc., IPR2015-01755.

The United States Patent and Trademark Office Patent Trial and Appeal Board also denied a petition for Inter Partes Review by Globus Medical, Inc., concerning Flexuspine, Inc.’s U.S. Patent No. 7,316,714, entitled “Artificial Functional Spinal Unit Assemblies.” The case is captioned, Globus Medical, Inc. v. Flexuspine, Inc., IPR2015-01721.
