Complaint Filed by Medline Industries, Inc. against CR Bard, Inc. for Catheter Patent

March 24, 2016 – Plaintiffs, Medline Industries, Inc. (“Medline”) filed a complaint against CR Bard, Inc. (“CR Bard”), asserting infringement of U.S. Patent Nos. 8,746,452; 9,283,352 in the United States District Court for the Northern District of Illinois. Medline asserts that it is the owner by assignment of all rights and interests related to the asserted patents, each of which is titled “Catheter Tray, Packaging System, and Associated Methods”. Both of Medlin’s patents is directed to a single-layer proprietary Foley catheter tray, a package containing the tray along with associated devices (e.g., lubricating jelly, sterile water, and specimen container), along with instructions on using the package. According to the Complaint, the action arises from CR Bard’s importing into the United States, and offering to sell and selling in the United States the Bardex® I System. The case has been assigned to District Court Judge Sharon Johnson Coleman, and remains pending, Medline Industries, Inc. v. CR Bard, Inc., 1-16-cv-03529 (N.D. Ill.).
