March 29, 2016—Defendant Kaz USA’s motion for judgment as a matter of law was denied. The court denied Kaz’s subject matter patentability challenge to Plaintiff Exergen Corporation’s asserted claims, finding that the claims-at-issue did not lack an inventive concept. The patents-at-issue are U.S. Patent No. 6,292,685 and 7,787,938, both entitled “Temporal artery temperature detector.” The patents are directed to “non-invasive methods and devices for accurately determining a person’s deep body temperature by taking measurements of the skin temperatures over an artery.” The case is in the United States District Court for the District of Massachusetts, and is Civil Action No. 13-10628-RGS.
