ResMed Seeks 337 Investigation

April 19, 2016 – ResMed Corp., ResMed Inc. and ResMed Ltd. (“ResMed”) submitted a request to the International Trade Commission to commence a Section 337 Investigation against BMC Medical Co., Ltd., 3B Medical, Inc. and 3B Products, LLC (“Respondents”).  ResMed seeks a limited exclusion order specifically directed to each Respondent excluding from entry into the United States certain sleep disordered breathing treatment systems and components that allegedly infringe U.S. Patent Nos. RE44,453, 8,006,691, 8,020,551 and 9,072,860.  ResMed also seeks a permanent cease and desist order halting the importation, sale, offer for sale, marketing, advertising, or soliciting of sleep disordered breathing treatment systems and components thereof by Respondents that allegedly infringe the above patents.

The case is captioned In the Matter of Certain Sleep-Disordered Breathing Treatment Systems and Components Thereof and is pending in the International Trade Commission, ITC-337-3140.
