District Court Grants Defendants’ Motion to Vacate Stay and Reopen Crocs Inc. v. Cheng’s Enterprises, Inc., et. al.

April 25, 2016 – The United States District Court for the District of Colorado granted Defendants’ motion to vacate stay and reopen Crocs Inc. v. Cheng’s Enterprises, Inc., et. al.  The patents at issue are U.S. Patent Nos. 6,993,858, entitled “Breathable footwear pieces,” and D517789, entitled “Footwear.”  The case had originally been stayed due to reexamination of the patents.  The court applied the four-factor test articulated in Broadcast Innovation, LLC v. Charter Coomc’ns, Inc. in deciding to lift the stay and reopen the case.

The case is pending in the District of Colorado and is captioned: Crocs, Inc. v. Cheng’s Enterprises, Inc., et. al., 1-06-cv-00605.
